termination from employment - legal or not?

I have been on medical leave from a DOT regulated job. Dr's say I can't return to work yet (must pass federal phisical criteria first, first open date to be tested is after short term leave runs out)). Employer says that after short term leave runs out they will terminate my employment regardless of medical condition. Legal or not?

  2. My guess is that it is legal.
  3. If you reside in an "at-will" state then you can be terminated at any time without cause. The only dispute would be in regards to an unemployment claim.
  4. Unfortunately, it's probably legal even if it is also extremely unethical. Contact EEOC and/or an attorney for more information pertaining to your area.
  5. Read you contract of employment or letter of offer is this covered there?. If it is not, then ask them to give you the reason for termination so you can challenge it later, as you have a substantial excuse for not returning to work.
  6. Did the medical leave stem from something that happened on the job? I would call your state's labor board for that answer.
