Illinois Unemployment Compensation Laws?
I was hired with the agreement of having Sundays and Tuesdays off, 40 hrs per week, paid Federal Holidays after six months. Two weeks into the job, due to unexpected resignations, I am expected to work six days per week, and more than 40 hrs. (Three 11+ hr days, two 8+ days, and 1 6-1/2 day). At the same time, the company decided to be open Federal Holidays 4-1/2 hrs, of which I am required to work at straight pay, until 6 mths of employment at which time I will qualify for paid holidays and make 1-1/2 times my hourly rate. I still will be required to work. If I leave this position, will the circumstances enable me to draw unemployment? Please don't "guess", I need to know the law. The hours will most likely be reduced to 42 per week upon filling openings (another 2-3 weeks), but I still will be required to work Federal Holidays.

- Point One: Did you get your agreement in writing? Point Two: Overtime pay is a federal law, not a contractual agreement. If you are not exempt from the overtime requirements (due to your job duties) then they have to pay you overtime. If you can "earn overtime" after 6 months it sounds to me as if there is something funny going on..... Please check out the Department of Labor homepage at www.dol.gov to learn more about wage and hour laws. For information on employment contracts, if you got one, call an employment law attorney in your area. For information on specific regulations in Illinois Unemployment Compensation, contact the Employment Security Comission in your town. They can give you the scoop right from the horses mouth.
- You need to read the law yourself to be sure. Here is a link to the IL Dept of Labor web site.
