What constitutes a Request for Production under Federal law?

What constitutes a reqeust for production under Federal law, specifically Rule 34? Is an employment authorization considered a request for production....especially where you don't have the records in your possession?

  1. Rule 34 states: "Any party may serve on any other party a request to produce... documents....which are in the possession, custody or control of the party upon whom the request is served." You have 30 days to respond. Therefore, you file "Answer to Request for Production" and state: "None of the documents requested by __________are in my possession, custody or control." That's it, but you must answer the Request.
