I would like to find out if you have an ex husband that is going to retire from a government job I was told even if not in the divorce papers that the ex husband is given a paper to the ex wife to say yes she takes the retirement or no she does not. This was told by an FBI agent I would like a website on this to verify please.

Generally, all assets-- including pensions-- are divided during the divorce proceedings. If a spouse is given some portion of a pension, then an order is issued (referred to as a Qualified Domestic Relations Order or QDRO or the like) that describes the distribution of pension monies. Since QDROs are not always forwarded to the pension organization but just sit in a case file in the court or at an attorney's office, the pension provider will sometimes ensure that an ex-spouse is given notice that the pension is going to be disbursed. The spouse will be told to contact the pension provider if the spouse is entitled to a portion of the pension. This notification does not create a right to a portion of the pension. It merely provides an ex-spouse with the opportunity to assert a claim against the pension-- as those based on an existing QDRO. [This is not legal advice.
