My wife got a 1099- misc. I started doing our taxes and it says we have to file a SS-8 form to the IRS.?

Can I filed our taxes without filing the SS-8 form first, or do i even have to filed this since we are paying the extra taxes when i file. >>>>>>>> SS-8 form is a Determination of worker status for purpose of federal employment taxes and income tax withholding.

  2. If your wife received a 1099misc for non employee compensation then you must file a Schedule C claiming income and deducting expenses and Schedule SE to calculate self employment taxes. You would file form SS-8 if you believe your 1099-MISC income should have been considered wage income and wish the IRS to make a determination of your employment status.   3. File a schedule C with the income information of the 1099misc. Claim any expenses that you had with this business and say that the income is subject to SE taxes. You may not have answered the questions correctly. You are responsible for both federal income and self employment taxes with a 1099misc.
