Can place of employment set their own hours or do they have to go by the federal laws of that state?
I am thinking about 8hr days now 12 hr days for an example

- Set their own hours. Most places are required to pay overtime for any hours worked over 40 in a week. That would normally be like Monday to Sunday. My current work week runs Tuesday to Monday. Union jobs will or may require overtime pay for any hours worked over eight in a day. That would be unless you are contracted to say work for ten hour days than it would revert back to 40 in a week.
- Places of employment must follow the more stringent of either federal or state laws (for example, there is a Federal minimum wage law, but some states have higher state minimum wage laws, so in this case, the state law would hold sway for businesses in that state). There are no federal laws that regulate the number of hours worked in a day. The only regulation on the federal level are those pertaining to overtime, which state that once someone works over 40 hours in a calendar week, the employer must pay time and a half for that time over 40 hours worked. Check with your state department of labor to see if there are any state laws covering hours worked in a day.
