Are gays covered by federal antidiscrimination employment legislation?

I heard civil rights of 1964 amended by civil rights of 1972 do not covered gays.

Public Comments

  1. they are covered as of 2008.
  2. I think so, in most states. I think I heard that Nebraska is the only state without it.
  3. Currently, 13 states and the District of Columbia have policies protect against both sexual orientation and gender identity discrimination in employment: California, Colorado, Connecticut, Iowa, Illinois, Maine, Minnesota, New Jersey, New Mexico, Oregon, Rhode Island, Vermont, and Washington in the public and private sector. Hawaii, Maryland, Massachusetts, Nevada, New Hampshire, New York and Wisconsin have state laws that protect against discrimination based on sexual orientation only. Fifteen other states have laws that have been interpreted to protect transgender persons. (Taken from Wikipedia)
  4. No, we are not protected by those amendments. In fact, in my state (FL) it is legal to hire or fire based on sexual orientation. Correct me if this has changed. To the person who answered "they are covered as of 2008," did I miss some legislation that passed ensuring non-discriminatory practices toward gays and lesbians? I stay pretty up to date with this stuff. Correct me. I'd like to know. I believe it is up to the states to determine whether or not the gays and lesbians in their jurisdiction are protected from discrimination at the moment.
  5. I believe they are.If so,why is the U.S military,as an employer, still legally allowed to discriminate? That pi$$es me off.
  6. United States federal antidiscrimination employment laws cover Ethnic/National Origin, Color, Race, Religion, & Sex. They do not cover sexual orientation. The Employment Non-Discrimination Act, which would add sexual orientation to federal antidiscrimination employment legislation, has been proposed more than 20 times beginning in 1974 but has never been passed into law. Although it was passed by the House of Representatives in 2007, it was never voted on in the Senate.
