Does Affirmative Action apply to private company employment process (in US) too?

I know public government or university have to employ certain numbers of minority. But do private company also have to hire minority?

  1. Legally, no. In fact, the company is supposed to be blind regarding race or sex meaning they shouldn't take a person's race into consideration at all. However, in our social reality, many companies are aware of their public image and will often go out of their way to recruit minority and female candidates.
  2. Yes. Private companies are REQUIRED to reflect the population in the area where they are located. This applies to companies of a certain size.
  3. No employers are required to employ certain numbers of any group. Affirmative action refers to efforts made to increase employment opportunities when previous actions have caused an under-representation of qualified women, blacks, hispanics, etc. Private employers are subject to Title VII of the 1964 Civil Rights Act. That law requires there be no discrimination due to race, sex, religion, or national origin. The law protects all applicants and all employees, no matter what race, sex, or national origin they may be.
  4. Yes, but only federal contractors. Most large companies, however, are federal contractors. This rule applies to all entities, public and private. There is no rule that public governments or universities have to employ certain numbers of minorities. In many states, neither companies nor universities are allowed to have quotas of any kind.
