List 4 U.S. federal employment laws and/or U.S. regulations which would directly apply to this scenario.? Sally has worked as a front desk clerk for ABC Clinical for ten years. Her manager (Jack) states that she is a hard working, loyal, and dependable employee. During the past year, however, Sally has had many personal problems, such as a divorce, inability to obtain childcare for a handicapped child, and chronic depression. Due to these problems and others, Sally’s attendance has been sporadic. She is currently seeing a psychiatrist for depression, which renders her unable to get out of bed at times. Even though she has been given two verbal warnings and one written warning, her attendance problems persist. Her tardiness is causing other employees to work overtime to do Sally’s work. Jack doesn’t want to terminate her, but he can’t continue to burden his staff with additional work due to Sally’s frequent absence. In addition, he is concerned that Sally may commit suicide if she is terminated. Sally has currently used her annual allotment of sick, vacation, and personal days. ABC Company is private and has 26 employees total.
How a federal employment law differ in application from a state law? I need to write an essay regarding this matter, can someone tell me an internet site than contain more details regarding the difference? Thanks
Reprisals at Federal employment, regulatory agencies (Federal) will not stopping it. Where to go next? I have been subjected to numerous Reprisals at my Federal employment for my filing a Workmens Compensation/Family Medical Leave Act claims. None of the Federal regulatory agencies will assist in stopping these actions that violate the Federal Employee Labor Manual (ELM), our collective bargaining agreement (aka "contract"), and several Federal Laws (some with "criminal punishment" possible). Where to go next for help?
Federal or state laws for pre-employment screening for health care workers? Is it required by law for those working in health care fields to be pre-screened in any way?
Ohio Employment Law versus Federal Employment Law? I am trying to find an employment protection that is provided by the Ohio system, but not by the federal system. Any suggestions.
Is it smart to leave federal employment for law firm? I work for the federal courts as a case manager and a local big law firm is offering a lot more money to work as a paralegal. The benefits are great and they have MORE opportunities for advancement.
NJ Employment Law versus Federal Employment Law? I am trying to find an employment protection law that is provided by the New Jersey system, but not by the federal system.

Does anyone know the federal laws in referance to background checks for employment ??? Just wondering how far back an employer can go, and where I can find the guidlines and employer has to fallow,
illegal immigration, employment contracts, and non compete clause? last year as a senior executive in a company, i discovered they were in violation of state labor laws and federal employment laws, hiring illegal immigrants and providing undocumented workers with false documents so they could work under various names (avoiding over time). i moved to stop the practice and was told it was the "only way" for the company to do business at the time. i resigned my position rather than jeopardize myself. my question is, because they were in violation of laws, is my employment contract's non-compete still in effect?

Can employment medical checks access all your medical records? I got hired by a federal law enforcement agency and must now submit to a medical exam. My physical will be with an in-house federal doctor. I know that the agency can access the results of this physical, what I am wondering is if they can access my complete medical records. I've read that they can only access records that I give them consent to look at. For example, if I sign a consent form to look at my records at "Hospital A", they can. However, if I made no mention about my records at Hospital B and never gave consent, then they cannot access those records. I'm wondering if this policy is true? Also, when it comes to medical records, do they even care about anything but the results from the physical. I'm getting the feeling that the medical exam isn't a big deal, they just want to see if your capable of walking, talking, hearing, seeing, and other basic activities?
Laws regarding Equal Employment Opportunity? What are the major federal laws regarding Equal Employment Opportunity? How does an organization incorporate affirmative action into its recruiting strategy?
Question on federal law enforcement employment eligibility? When I was 19 years old, I wanted to find what it was like to have sex. I made arrangements with an escort, and we had sex. I understand that this constitutes prostitution. Does this bar me from federal law enforcement? My record is clean, but I am aware that there is a polygraph exam. Of course I will be forthright and completely truthful, but I just want to be prepared if this incident is a big deal. That way I know not to put all my eggs in one basket. Thanks.

Are there any employment laws regarding breaks? If an employee (over 18) in Pennsylvania were to work 8 hours straight with no breaks, would any federal and/or state laws be broken?
Aiding and abetting illegals: Misdemeanor, or felony? Should there be fines and legal penalties for knowingly aiding and abetting illegal aliens attempting to circumnavigate immigration and employment laws, and other relevant aspects of state and federal law? We, as citizens, are expected to abide by, and live within the law, how are illegal aliens from ANYWHERE somehow magically exempt from this? Is there a disconnect in our own government somehow as to what 'legal' means, are we back to defining 'is'?
What do you think would happen to state employment... ....? if the federal government decided that rather than passing laws and making states carry them out it would simply give the states responsibility for a major social program like welfare? Do you think that it would create a lot of new jobs for the state, but how would they afford to pay all these people? Caotic?!
Are labor laws different between contractors and normal employees.? I am a security officer working for a company that is protecting a federal building. My question is do we fall under normal employee laws or is there a excemption for contracted employment. I am located in texas
Employment Discrimination Lawsuit (Federal or State Court)? Why would a civil lawsuit be filed in Federal Court instead of a State Court? Does it have any benefit to the attorney upon settlement? Is there more case law in Federal that justifies attorneys fees? I am just not certain why an attorney would choose one over the other.
Should the Bank officers of the failed banks that received federal money have their employment terminated? Should they be prosecuted under the federal anti-racketeering laws (RICO), have their assets seized, and set to prison for the maximum allowable term without parole? Or should we bail them out with federal tax dollars, pay off their bad gambles, let them keep their ill gotten gains and let them walk. Or maybe just swat them on the nose and place them under house arrest? The fraud that they perpetrated against the American taxpayer is not any different that what Bernie Madoff or R. Allen Stanford did to his investors, just on a much larger scale. I doubt it will happen with Eric Holder as AG. He doesn't have the moral courage needed for the task. Remember, he worked on a pardon for Marc Rich, the fugitive billionaire tax evader once on the FBI's Most Wanted List whom Clinton cleared.
Federal Government employment? I just received a job offer with the federal government, and reading the details of the job announcement it says that candidates will be required to complete a form OF-306 prior to employment. My concern is question #9 on the form. Several months ago I received a public intoxication fine and I was jailed for a few hours as well. It was a class C misdemeanor, and actually quite a trap that the city set up. The apparently passed new laws which prohibits drinking alcohol in a certain park near a very popular river...that seemed to round up many people and take them to jail for this...quite the income maker for the city. Anyhow, I will disclose this of course on the form, but I am curious as to whether that will affect my job offer....any thoughts?
Important question!! employment laws!!!!? Hi everyone!! i have an important question!, can my employer fired me without notice after being working for them for more than 6 months! isn't there a federal law that prohibits this? they made me sign a document when they hired me (at will employment), that means that they can fired me whenever they want and for whatever reason without notice! and i've heard that it is ilegal to do so!!, i need some advice!! i would love to know where to read about it and what to do if something happens!!! thank you so much i really appreciate your answers!!!

What Are Some Entry Level Federal Law Enforcement Careers? I could take a local or a state job and use that experiance and get in later, but for now I'm wondering what starting/entry level federal jobs are out there in Law Enforcement with the Feds. I already know of a handful. Probation Officer (or Probation Officer Assistant depending on district)... Postal Inspector (did hear it requires a year first in general employment with the postal service, so it's not really 'entry' level)... Border Patrol/INS (though my vision fails their standard)... Secret Service (same as above but it's closer, though I've also heard they only theoretically hire entry level, in practice they only hire those w/ experiance)... What else is there out there that allows entry level into a federal law enforcement job? (IE it has a GS rank or equivalent, and it has either/or arrest powers, firearms cert., or some form of criminal investigative authority). Marshalls and FBI are out since they only hire prior exp or Masters degree, but what about the IRS, etc? Ran out of room... I also know of the capital police in DC, but I'm looking for Fed jobs that work across the whole country not just in DC. (training there is fine, but your whole career being there to me it might as well be a local job) By entry level I also mean it requires between no education and a Bach degree (I have a Bach), and you can get hired if you have less then a year of experiance. If it requires a post-grad degree or more then 1 year job experiance, I consider that non-entry level. However if people want to add jobs that have strict vision or Masters degree requirements feel free, since other people might look here and find that stuff useful even though I don't personally. Thank you, but I was already aware of USAjobs and several other broad job search sites. I wasn't asking for sites or general info or opinions on what people think of federal law enforcement. Those may be good question or answers, but aren't dealing with my specific question here. I am only interested in actual job titles/agencies, not in search/metasearch job sites or opinions on the field as a whole. Nothing wrong with that, it's just I can already find the first on my own, and can formulate my own of the second. Thanks for the BoP one, I didn't realize that was such a good way into the Air Marshalls... the veteran affairs I looked into, but it heavily favors people w/ veterans pref. points in hiring, and I don't have those.
Does anyone know where the law is for a verification of employment? is there a texas state or federal law stating that the employer is not allowed to give out an employers salary even with borrowers authorization to qualify for a home mortgage loan, more or less, an FHA loan? if there is please give me a link. or if there as anything regarding them having to with permission.
Do hospital policies supercede employee at will laws? HIPAA is a federal standard, that must be the miniak standard. If a locality or buisiness has a more strict policy, then legally those policies must be upheld. How can this be applied to employee at will? When I was hired I was promised an Ombudsman and policies that would protect me from unfair treatment. I was fired for reporting billing errors. Where can I find the actual legislation on line regarding employment law?
A federal transgender employment protection law? I just heard from NPR that a section of a bill that protects trans gender workers from discriminatory firing has been dropped. What can we do to get it back? Is there a petition that people can sign to get this section put back into the bill?
What constitutes a Request for Production under Federal law? What constitutes a reqeust for production under Federal law, specifically Rule 34? Is an employment authorization considered a request for production....especially where you don't have the records in your possession?
How many federal, state and local laws does the typical? illegal immigrant break with their false I.D.'s.illegal employment ,etc? I really am curious as I've never heard it mentioned anywhere -and it's usually made to seem not such a big deal that they are breaking laws.
Are there any federal or state laws against student discrimination? A friend of mine attends the same local community college as me. She has had several instructors discriminate against her based on her sexual orientation and appearance. She has now been forced to utilize the option of a self study program to avoid this disparate treatment. She does not wish to pursue any action against the school. I, however, seek to ensure that this treatment does not continue. Not only for her sake, but to ensure that all students are treated equally. I am aware that Title VII of the Civil Rights Act protects minority groups from employment discrimination. However, are there any laws that protect students from being discriminated against by teachers? If so: -What are they? -What agency enforces them? -Do the law(s) prohibit discrimination based on sexual orientation? If not: -Do you know of any organizations or groups that are currently fighting this issue? I live in North Carolina but I am interested to see if any other states have laws regarding these issues.
In what courts are employment/labor law cases most often tried? I am a pre-law student about to enter law school with an interest in labor/employment law. I’m wondering, where are most labor/employment law cases tried. Being that employment law heavily involves the Civil Rights Act and the ADA, are these cases tried in the federal courts? I’m trying to get a sense of just how important courses in the federal courts are to this area of law.
Is a discretionary trading trust with a corporate trustee a "constitutional corporation" under Work Choices? If employees are employed by Trustee Pty Ltd as trustee for Trading Discretionary Trust, is the employer regarded as a "constitutional corporation" under the Work Choices laws (which would bring the employees under federal employment laws, rather than under state awards)?

How do I know if I have employment authoriztion? I'm trying to get a job for the first time. I'm filling out an application right now for WinCo FOODS. There is a question that asks, "Can you, after an offer of employment has been made, submit verification of your legal right to work in the U.S.? (Federal Law requires proof of identity and employment authorization for all new hires.)" I have a driver's license to prove identity but how do I prove that I have employment authorization?
Texas Work Laws for Minors? Federal vs State Law? The State of Texas is more leniant on how many hours a 15 year old person can work, the federal law restricts it even more. my question here: ARE WE REQUIRED TO FOLLOW BOTH FEDERAL AND STATE LAW or DO WE FOLLOW THE STATE LAW ONLY, or DO WE HAVE TO FOLLOW THE FEDERAL LAW? "Hours of Employment under State and Federal Law Texas State Law: A child 14 or 15 years of age may not work more than eight hours in one day or more than 48 hours in one week. A child who is 14 or 15 years of age and is enrolled in a term of a public or private school may not work between the hours of 10 p.m. and 5 a.m. on a day that is followed by a school day or between the hours of midnight and 5 a.m. on a day that is not followed by a school day. A child who is 14 or 15 years of age and is not enrolled in summer school may not work between the hours of midnight and 5 a.m. on any day that school is recessed for the summer. Federal Law: Under the Fair Labor Standards Act (FLSA) a child 14 or 15 years of age may not work during school hours, may not work more than three hours on a school day or 18 hours during a school week, and may not work more than eight hours on a non-school day or 40 hours during a non-school week. Furthermore, a child 14 or 15 years of age may work only between 7 a.m. and 7 p.m. during the school year. Between June 1 and Labor Day, a child may work between the hours of 7 a.m. and 9 p.m. A child 16 or 17 years of age have no restrictions on the number of hours or times of day they may work." http://www.twc.state.tx.us/ui/lablaw/cllsum.html
Employment Law? Health and Safety Regulations. Denton and Carlo were employed at an appliance plant. Their job required them to do occasional maintenance work while standing on a wire mesh twenty feet above the plant floor. Other employees had fallen through the mesh; one was killed by the fall. When Denton and Carlo were asked by their supervisor to do work that would likely require them to walk on the mesh, they refused due to their fear of bodily harm or death. Beause of their refusal to do the requested work, the two employees were fired from their jobs. Was their discharge wrongful? If so, under what federal employment law? To what federal agency or department should they turn for assistance?
Can you confirm any arbitration award in federal court? In the United States, the Arbitration Act of 1925 is a federal statute. I understand that federal courts have jurisdiction to hear a case, regardless of any diversity of citizenship, or the amount in dispute, if the case asks a federal question. Case in point: Employment discrimination. So, since the Arbitration Act is a federal law, can an arbitration award be confirmed in federal court, even if the case would have been referred to state court, if it had been litigated? Also, can you provide a reliable source?
Why do Federal agencies REFUSE to regulate Federal employers? Federal employer is actively violating numerous Federal Laws and regulations, yet "regulatory agencies" REFUSE to even conduct legitimate investigations. Much less take any action to bring to an end the violations of the employees' rights. My Federal employer is a "unionized" place of employment (LOL), but the employer has taken steps to IMPROPERLY influence the union steward through unlimited absences and "illegal suspensions", so the employer can then PAY the union steward for NOT being present to represent the employees!
Where should I have my attorney file my Employment Discrimination complaint in State or Federal Court? Which court is better to file a civil lawsuit complaint for the disabled is it state court or federal court? Both civil courts have disability laws so which civil court is better state or federal? Oh, and the federal judge that will be assign to my case if I have my attorney file it in that court is an old jerk.
Can millions of liberal draft dodgers in Federal employment breathe a sigh of relief today? Looks like some Liberal judge has given them a break. http://news.yahoo.com/s/ap/20090127/ap_on_re_us/selective_service_law I know Joe Biden is sleeping easier over this.
Can I be hired for a federal law enforcement position despite a previous instance of depression? I'm applying for a federal law enforcement position and have already been given a formal offer of employment. However the offer of employment is contingent on me passing the medical records check (physical) and FBI background check. The medical records check asks if I ever had an "emotionally stressed or mental condition, and if I had even seen a psychatrist." Over 6 years ago I did see a psychatrist (1 time) because I was feeling homesick in my first year of college. She prescribed me an anti-depressant which I took for about 5-6 months. I haven't seen a psychatrist (or any type of counselor) or been on any medication since that single time. Do you think this will still prevent me from getting the job? Has anyone been in this situation before?
A previous employer does not allow employees to give job recommendations for former employees. Is this legal? A former employer restricts current employees from giving job recommendations for former employees. I have a number listed as references as I worked at the firm for over 12 years. Is this restriction legal under Texas and Federal employment law? Doesn't this restriction violate my ability to market myself to prospective employers and what are my options short of a civil suit?
FEDERAL & STATE (PA) LABOUR LAWS regarding provision/distribution of benefits to F/T / P/T employees? - WHAT DOES THE LAW DICTATE? - Does Federal/State Law trump company policy? -Whats the statute of limitations (time window) on a suit? - Can the cost of future health expenses of the litigant (those directly related to the suit, and those directly resulting from denied heath benefits during the time of employment) be incorporated into the suit on the premise that those expenses would never have existed had those health benefits been provided?
Can I get a few pointers on Federal Law Enforcement duties ? (FBI-DEA-US Secret Services-) Beside jurisdiction bound how are the feds different front local/state agencies. I am earning my Bachelor in Public Safety Management. I am researching this to determine a choice of employment and particularity education.
What criminal history information is available if the Target Corporation ran a background employment check? I know there are federal and state laws governing this issue. I'm wondering exactly what information is disclosed during a background check. I'm asking because I was a former police officer who got charged with two felonies and two misdemeanors (domestic incident) a month ago. The charges are false and are being fought with an attorney. Don't wanna go into too many details, but all charges will be dropped in the end. The victim doesn't want to testify, and never did. No victim, no case. Anyways, I know that if I applied to be another police officer or work for a Police Agency, they can run a special background check that will show the arrest, but if a private corporation say Walmart, or Target were to run my background for an employment check, only Felony Convictions would show up right? Or would the arrest show up as well? I know the application only says to list convictions, so im not listing anything. I just really want this job!! Pays very well with good benefits! :) Anyone?
Do you think that there is a such discrimination in the United Arab Emirates? The US Equal Employment Opportunity commission (EEOC) was established by the title VII of the civil rights act of 1964 and began operating on July 1965. EEOC enforces the principal federal statutes prohibiting employment discrimination*. The US Federal laws prohibiting the following job discrimination: - employment discrimination based on race, color, religion, sex, or national origin -protects men and women who perform substantially equal work in the same establishment from sex-based wage discrimination. protects individuals who are 40 years of age or older. - -prohibit employment discrimination against qualified individuals with disabilities in the private sector, and in state and local governments; - prohibit discrimination against qualified individuals with disabilities who work in the federal government. The U.A.E constitution stated that; Equality and social justice and the provision of security and equal opportunities for all citizens is the pillars of society. Do you think that there is a such discrimination in the United Arab Emirates? And if there is... What is the best solution to avoid such discrimination? Awaiting your comments. Revised proofreading request for letter to boss? Any helpful hints for this letter? thanks. It's rather long, so mat take a few minutes to get it all posted. Dear Mr. Rasmussen, I’m writing in regard to a letter I sent you notating several instances in which your new Washington Branch Manager, David Manthei, has acted in a grossly inappropriate manner. In fact, Mr. Manthei has violated federal employment laws including, but not limited to, asking direct specific questions about my marital status and questioning the validity of restrictions my doctor has placed me under due to my current high risk pregnancy - going so far as to ask me if I really thought I would have a job with Rasmussen Equipment after delivering my twins. There have been several other instances of blatant discrimination against women. I thoroughly enjoy working for Rasmussen. I love every aspect of my job, be it conversing with customers over the phone, interacting with Salt Lake employees, or dealing with customers face to face. I feel that all the Branch 2 employees get along very well, with a relationship akin to family. I love working in this type of atmosphere. It has truly been a pleasure to come in to work each morning, and difficult to leave each night, until recently. Mr. Manthei has gone out of his way to alienate the employees of the Washington Branch. I have seen this in the way he talks down to the mechanics, in the way he orders Jim about, and in the way he requires the administrative assistant to perfom menial housekeeping tasks on a daily basis including but not limited to sweeping the floors nightly before leaving. These tasks are done regularly by a commercial cleaning service. When the cleaning service is in the office to do the tasks they have been hired to do, Mr. Manthei stands silently over them no matter where they are or what they are doing. The first week Mr. Manthei worked here, he called the team leader of the cleaning crew into Kerry’s office and interrogated her to the point that she refuses to ever allow her crew to return. Our account has been given to a different crew. There have been instances in which Mr. Manthei has behaved oddly with customers. Lorin, who is with R&W , came into the office recently to order some parts for one of his company’s machines. After finishing his business with Jim, Lorin started toward the door of the office to return to his vehicle. Mr. Manthei hurried up to him, clapped his hand on Lorin’s shoulder and said, “When they mess up, and they will, you come to ME and I’ll take care of it.” I am increasingly disturbed with the progression of events I have witnessed. Most recently, Mr. Manthei told Jim that we do not handle customers in the order of arrival, or phone calls in the order they are received. We are to handle customers according to Mr. Manthei’s direction of importance on a daily basis. However, Mr. Manthei immediately passes customer phone calls to Jim or a mechanic. Every customer that walks through the door is directed to Jim regardless of what the customer needs. All phone messages relating to a customer call are given to Jim. There is no coherent direction from Mr. Manthei. I look forward to any questions or comments you may have for me at this point. Also, I am including a copy of the original letter I sent, in the event you have not yet received it. Sincerely, **okay. red editing pen time. bring it on.**
Question about Federal/State law enforcement careers? Hi everyone, i'm new on yahoo! answers, so ill try to be as quick as possible. I'm a college freshman studying criminology/international relations. Though I have a few years, my main career interests are either State Police (NJ), or something in the Federal Government. Some may be able to answer some of my questions and not be able to with the other, answer what you can. 1. What chances does a recent college graduate have at getting into the State Police Academy? I understand it is pretty competitive, but some do try. (I have been on the website and know the MINIMUM requirements) 2. What would be more helpful to me in getting Federal Employment? Stuyding abroad in the Dubai , focusing on Middle Eastern Affairs (includes Arabic classes), or spending a semester interning in DC through the Washington Center with some agency? I appreciate any help anybody can offer.
On what basis can employers discriminate in hiring? Employers can discriminate against smokers. Obviously, they should discriminate based on ability to do a job. If there are no workplace requirements for an attribute, can a large employer legally discriminate by: -sex -age -weight -race -sexual orientation Have federal laws or court decisions eliminated some of the employment discrimination protections?
Would you support federal protection for Transgendered people? Current federal hate crimes law does not cover anti-transgender hate crimes. Currently only six states and 60 + localities have laws that protect transgender people from discrimination in employment. Transgender people frequently face untrained, insensitve or hostile health care providers who either cannot or will not adequately treat us. The criminal justice system subjects transgender people to harsh and unequal treatment. Transgender people are often refused access to gender-appropriate facliities like bathrooms, locker rooms and housing.
bad advice what do you think? Don't you think that the following advice (The lawsuit part) I received from another website is bad advice: I think that anytime a manager is in a bad mood they should not open their mouth. With Tania it seems if she is in a bad mood she starts being unprofessional herself and creating a hostile work environment. I told you before and I will tell you again, if you want that woman removed quickly then you and at least one other staff member has to file a lawsuit against your firm for creating a hostile work environment. Believe me, once your company gets served they will move mountains to get Tania out of there because failure to do so could end up meaning they pay millions of dollars in damages to those who filed suit. There are federal employment laws against being treated the way Tania treats you all. HERE IS THE STORY I ASKED ABOUT: I work in a large company. About a year ago Tania replaced the male manger who everyone loved. Tania is very mean spirited and is always moody. You never know if she is going to be mean or nice. She has caused such friction in our department that people are at each other throats. Our clients have been noticing a change in my coworkers spirits. And yesterday she called one of our most professional workers unprofessional due to the fact that this coworker had to leave because of an emergency at home. Tania will write people up for nonsense (for things she could just ignore). The reason I think the advice is bad is because I need my job so why would I cause friction and file a lawsuit. After that I would have to quit my job. Also one major client called the CEO's office and told the CEO what is happening in my department.
Why are white men under 40 not in the protected class? Individuals of a minority race, women, older people, & those with disabilities who are covered by federal laws on equal employment opportunity are in the protected class.
Is promotional preselection against the law? If someone in your company secretly promoted an individual (including sending them to training) before they even posted the new position whilst not giving others the opportunity to apply for it, is it against the law? I know it is with federal employment, but what about private companies?
Can a current federal employee ask for more money in a federal civil lawsuit once his case is out of the EEOC? I won in the Equal Employment Opportunity Comission and had to file a fedral civil lawsuit against Social Security who I work for. My attorney says I can only get what I won in the EEOC, but I thought when you filed in federal court, even if you are a current federal employee, you can get more monetary compensation than what is allowed in the EEOC because it is a civil trail and longer under control of the EEOC, I am right and what is the law or statue? Help!

Holiday Pay for Employees of Federal Government Contractors? I am employed by a company that has a service contract with a US government agency. I do understand that in the private sector in general, to offer or not to offer holiday pay is completely up to the employer; is not mandated by law. But what about employment under a government contract? Is the McNamara-O'hara Service Contract Act applicable here? Can you point me to any authoritative resources one way or the other?

Employment length Question? I've heard two different things on disclosing employment. I've heard that if you're at a job for 3 months or less, that its a matter of choice as to if you disclose it or not. I've also heard that there's a federal law that says that if your at a job for 3 months or less than you're under no obligation to disclose it. Is there a law? Yeah I know. My last job I was only at for 3 months and quit. It was in terrible financial shape and I just wasn't comfartable working there. Sure enough, a week after I quit 10% of the company was laid off. Plus, I'm 35 and have been working since I was 15. If I listed all jobs I've had my resume would be 8 pages long at least.
NC Pre-employment drug screening? I've had a couple good interviews with a company. I received a call from the HR recruiter and he said - I must complete the drug screening/background check before an offer is made. I was told "there's no point in making an offer when come to find out you fail the screening." Is this legal? I've changed jobs before and it has always been, offer made/accepted - then you go do the screenings/checks.. Did this company violate NC/federal laws? Don't get me wrong, I want the job and will pass any/all tests. I've just always accepted the offer, then a couple days later do the testing/screenings..

How do you like this Social Security Admin. Report: Bush Administration Guilty of Hiring Illegal Aliens ? Social Security Admin. Report: Bush Administration Guilty of Hiring Illegal Aliens If President Bush is serious about getting tough on U.S. employers who hire illegal aliens, he can start with his own administration, which employs thousands of unauthorized workers, says the top Republican on the House immigration subcommittee. A 2006 audit showed federal, state and local governments are among the biggest employers of the half-million persons in the U.S. illegally using "non-work" Social Security numbers — numbers issued legally, but with specific instructions that the holders are not authorized to work in the U.S. "Let's clean up our own house, let's especially clean up the federal employment of all those working for the federal government," said Rep. Steve King, Iowa Republican and ranking member of the House Judiciary Committee's immigration subcommittee. The Social Security Administration used to, but no longer does, issue non-work numbers to legal aliens who were not authorized to work but needed a number to obtain a federal or state benefit or service. Still, hundreds of thousands of those immigrants used the numbers to get a job. According to the 2006 audit by the Social Security inspector general, 17 of the 100 worst employers using employees with non-work numbers were government agencies: seven federal agencies, seven state agencies and three local governments. That means the government knows who those employees are, but usually does not go after them. Earlier this month, Homeland Security and Commerce departments announced a new crackdown on illegal entry that includes stricter enforcement against employers. The departments said they will encourage businesses to use E-Verify to check employees' Social Security numbers, and said the federal government will write new rules requiring all private contractors and vendors that do business with it to use E-Verify. Under current law, neither business nor federal agencies are required to use E-Verify, formerly known as the Basic Pilot Program. Mr. King said the administration shouldn't wait for new rules to begin checking federal employees against the non-work list. http://washingtontimes.com/apps/pbcs...108230096/1001

Why is the initial cut off level for thc 50 ng/ml, but 100 ng/ml for employment screening in Hawaii? Why are people in Hawaii able to have more thc in their system (100 ng/ml vs. 50 ng/ml) when they are screened for employment ? If this was a law passed by the state, why is it permitted by the federal government while they deny the ability of the states to permit medical marijuana?
What do you know about civil rights in US today? We all know that there is no same sex marriage in US. But did you know the following: •There no policies banning sexual orientation and/or gender identity employment discrimination, either in public or private sector in 19 states on US? •There is no federal law banning discrimination based on sexual orientation and/or gender identity when it comes to the fair housing law? •There are states, constitution of which BANNES civil unions? •In the United States, Federal law does not restrict discrimination on the basis of homosexuality? •On June 30, 1986, the Supreme Court of the United States ruled in Bowers v. Hardwick, that homosexual citizens had no constitutional right to privacy. •On June 28, 2000, the Supreme Court of the United States ruled that the Boy Scouts of America had a First Amendment right to exclude people from its organization on the basis of sexual orientation, irrespective of any applicable civil rights laws. Next time if anyone will ask you a question “What is the gay agenda” or “Why gay people are making such a big deal over your sexuality” just simply point out these facts from above…. Needless to say, listed above are just few examples out of many others… Papa M, what is anti American in my question? issues of self interest? What makes you think that you know how am I spending this day of 9/11?
How do you get your rights protected when dealing with a Federal Employer? I have been subjected to numerous discriminatory actions by my Federal Employer, which violate my rights under FECA, FMLA, OSHA, FLSA, Whistleblower Act. Yet according to the "other" Federal agencies that oversee compliance with these laws..........the employer must "confess" to the discrimination, or NO discrimination exists. So far, I have been unable to locate an attorney that will take on my Federal Employer in court, even with most of these actions being documented. Several of these law violations even permit fines, and possible jail time for the offenders...........yet not able to locate a Labor/Employment lawyer willing to take the case.
describe how the federal and state systems of governement may or may not differ in their application of employ -ment laws.Provide at least one example of an employment protection that is provided by Georgia state system, but not by the federal system.

Illegals facts on employment in the US!? UNEMPLOYMENT At the time of this writing there are over 7,500,000 unemployed Americans who are actively seeking jobs, many of which are taken by the more than 12,000,000 alliens currently in the United States. Our brilliant politicians have established a minimum wage of $5.15 and hour, which becomes approximately $50 a day with various government fees. Minimum wage jobs go to illegal immigrants who will do them for $2 a day. Is the problem really that Americans are lazy and don't want to work as defenders of illegal immigration say? The facts are: -Companies will have problems with the federal government if they pay less than minimum wage to citizens or legal immigrants. -The federal government does not actively enforce laws against hiring illegal immigrants for well under the minimum wage. -Illegal immigrants live in squalid conditions, often 4 or more to a room supported by churches and other organizations. If Americans worked for $2 a day they would be homeless. Are Americans not willing to take these jobs? Are Americans not willing to work for $2 a day? Are Americans not offered these jobs because of minimum wage? Minimum wage does not guarantee that Americans will have a minimum income when others work for less. It guarantees that millions of Americans will be unemployed. The federal government allows employers to violate immigration laws, tax laws, and minimum wage laws. Politicians, including George Bush, routinely refer to illegal immigrants taking "jobs that Americans don't want". American citizens collect garbage, clean out bed pans, and clean toilets. They used to work as cooks and dishwashers in restaurants. Politicians fail to explain exactly what jobs Americans don't want when the unemployment rate is over 5%. The fact is that an employer must pay minimum wage, and often other fees, when hiring a citizen or legal immigrant.
Gays say hate crime laws pose no threat 2 speech and religious freedom- proof shows otherwise-why not admit it Marriage as Hate-Speech Case Filed with US Supreme Court The Pro-Family Law Center has challenged Ninth Circuit Court of Appeals and United States District Court rulings finding the terms "marriage," "natural family," and "family values" to be hate-speech. The case involves the threat of termination of employment by the City of Oakland against two of its employees who used such words on an employee bulletin board. (PRWEB) June 6, 2007 -- The Pro-Family Law Center of Southern California filed a free speech case on behalf of the City of Oakland's Good News Employee Association with the United States Supreme Court on Monday. In United States District Court, Case No. CV-03-03542-VRW, the California federal cou The suit arose in late 2002 when the petitioners chose to create the Good News Employee Association in response to alleged Bible-bashing by ranking city officials and open access given to various other groups over the City's e-mail and bulletin board systems. When the petitioners tried to express their views through a flyer posted on an open bulletin board, they were allegedly censored. The other groups are allowed, to this day, to publish whatever they'd like on the bulletin board and on e-mail systems. According to materials provided to the United States Supreme Court, one quote from an e-mail among city employees and officials said, "I personally think the good book (Bible) needs some updating" along with other alleged attacks on Christian values. Nothing was done about this e-mail from a sitting city council member. The publication of these words was met with a direct threat of termination from employment by the City of Oakland and resulted in the filing of the lawsuit with the United States District Court. To this day, the petitioners are banned from using these words in free speech forums set up by Oakland for its employees. http://www.prweb.com/releases/2007/6/prweb531074.htm

Tribal sovereign nations? Are tribal sovereign nations liable for abiding by federal discrimination laws with reguard to employment?
Why are the deprived or what we consider deprived discriminated against for meeting the legal requirements.? A person is deprived or legally found to be deprived under federal and stat laws for housing, employment, education and benefits. Because of this status they discriminatred against for what most times can not be help such as lossing everything in a fire or flood and being forced to moved into a shelter to being focred into homelessness because the rent is increased and welfare will not pay the increased rent or from false claims causing eviction due to a dispute of services, practices or policies. In education to carry the stigma of an income that meets one level but not another causing placement in a undergraduate program or failure to meet schools loans requirements or having a job that seem to be enough to live off but does not meet the need for lights, gas, electric or food. Finally after all of this cast aside because something is never enough not because the attempt was never made or better but because the system is made that way to fail or fall and give up. This is America?

Illinois Unemployment Compensation Laws? I was hired with the agreement of having Sundays and Tuesdays off, 40 hrs per week, paid Federal Holidays after six months. Two weeks into the job, due to unexpected resignations, I am expected to work six days per week, and more than 40 hrs. (Three 11+ hr days, two 8+ days, and 1 6-1/2 day). At the same time, the company decided to be open Federal Holidays 4-1/2 hrs, of which I am required to work at straight pay, until 6 mths of employment at which time I will qualify for paid holidays and make 1-1/2 times my hourly rate. I still will be required to work. If I leave this position, will the circumstances enable me to draw unemployment? Please don't "guess", I need to know the law. The hours will most likely be reduced to 42 per week upon filling openings (another 2-3 weeks), but I still will be required to work Federal Holidays.
Would officials of the IRS & Federal Reserve be punished for...? ...embezelment, attempt to defraud & treason if representative Ron Paul wins as our Commander in Chief? I've talked with a couple guys related to my employment & several others not related that have told me that being both agencies are literally conducting business illegally, & that an attempt to defraud or fraud has been comitted on & to federal property & others, that there is no statute of limitations. Is this true? I also have seen the freedom to fascist movie but it mentioned NOTHING about punishment regarding corrupt officials. Any body with legal knowledge on this issue please respond as I have NO experience in law of any kind.
